Apply for a certificate of completion

To establish separate ownership (condominium ownership) and partial ownership (commercial, basement rooms), you need a certificate of separate ownership for the individual units. Parts of a property located outside the building - such as parking spaces or gardens - can also be declared as separate property.

A certificate of seclusion is an official confirmation in accordance with the German Condominium Act that an apartment or usage unit is sufficiently separated (e.g. by walls, ceilings and a lockable entrance) from other apartments or rooms, i.e. that it is closed off and can be used to its full extent. Furthermore, parking spaces and areas on the property that are not structurally demarcated, such as gardens, can also be certified as enclosed if they can be clearly located on the respective property by means of sufficient dimensions in the plans.

Together with the subdivision plans, it serves to divide a building into residential and/or partial ownership so that these can be entered in the land register as independent units. In this way, a multi-party house can be converted into condominiums in order to sell them individually.

The certificate of separate ownership is applied for using the appropriate form at the Wiesbaden building inspectorate.

Reservation of approval for the establishment of residential or partial ownership

With the ordinance on the approval requirement for the establishment of residential or partial ownership and for the determination of areas with tight housing markets in accordance with the Building Code (Conversion Approval and Area Determination Ordinance), issued by the Hessian state government on April 28, 2022, the establishment of residential or partial ownership in accordance with Section 1 of the WEG in areas of a statute for the preservation of the residential population is subject to the approval of the municipality in accordance with Section 172 (4) BauGB.

In addition, for Wiesbaden, as an area with a tight housing market, buildings with more than six apartments that already existed before May 12, 2022, require approval for the establishment or division of residential property in accordance with Section 250 (1) sentence 1 BauGB.

The Wiesbaden City Planning Office - 6103 Urban Development isresponsible for questions regarding the approval requirement within the meaning of Section 172 BauGB.

The Office for Social Work - 5108 Housing Department isresponsible for the so-called conversion permit in accordance with § 250 Para. 1 S. 1 BauGB within the Wiesbaden city administration.

Application documents and information material on the certificate of completion

The following documents must also be submitted in addition to the planning documents:

  • Power of attorney
  • Description of changes (only for supplements)
  • Calculation of living and usable space
  • Real estate map
