Terms of use and advertising
§ 1 General
(1) The website www.wiesbaden.de is the official city portal of the state capital of Wiesbaden. The provider of the website is the State Capital of Wiesbaden (hereinafter also referred to as: Provider).
(2) This service is offered free of charge. The Provider reserves the right to change, expand, temporarily or permanently discontinue the scope of services at any time and to offer parts of it for a fee.
(3) The use of the www.wiesbaden.de platform is subject to these Terms of Use. Users accept these as soon as they have been made aware of them, have a reasonable opportunity to take note of them and continue to use the platform. The separate General Terms and Conditions (GTC) apply to products offered by the State Capital of Wiesbaden.
§ 2 Warranty/liability regulations
(1) All information and components of the homepage are compiled to the best of our knowledge and belief. No liability or guarantee is assumed for the topicality, correctness and completeness of the information provided. Nor is the provider liable for any damage caused by computer viruses or similar when retrieving or downloading data from this website, unless this is due to intent or gross negligence with regard to an essential main obligation of the provider. No liability is assumed for unforeseeable and contractually untypical damages.
(2) The provider is not responsible for third-party content to which access is merely provided via links. In particular, the provider does not adopt the content of these websites as its own, as it has no influence on the content and design of the linked pages. The use of links that lead to pages outside of www.wiesbaden.de is therefore at the user's own risk.
(3) The provider accepts no liability for the accuracy of texts in non-German languages generated by automatic translation. Any discrepancies or differences that may arise between the automatically generated translations and the only authoritative official German versions of this content are not binding and have no legal effect on compliance with or enforcement of regulations.
(4) The provider is entitled to block content if it suspects that the requirements of these terms of use are being violated. The legal responsibility for violations lies solely with those who have posted this content or created a link to it. You must indemnify the provider against any third-party claims resulting from your conduct and, in the event of a legal dispute, support the provider in the defense against any claims asserted.
§ 3 Copyright
The layout and design of the provider's homepage, the graphics used by the provider as well as the texts, images and audiovisual content are protected by copyright and may not be adopted, modified, reproduced, stored or processed in electronic or other form or used in any other way for purposes other than purely private use without the prior consent of the provider. This also applies to the selection, coordination, arrangement, expansion and other processing of third-party content by the provider. The individual contributions are also protected by copyright.
§ 4 Technical information
The www.wiesbaden.de service is subject to technical availability, in particular with regard to necessary maintenance work and outages due to technical faults. Users have no claim to constant, uninterrupted availability of www.wiesbaden.de or individual offers and services.
Detailed information on the technical requirements for using the www.wiesbaden.de platform can be found at the bottom of the page.
§ 5 Advertising on www.wiesbaden.de
www.wiesbaden.de does not contain any commercial advertising by companies.
It merely provides information on cultural, social and societal events and offers. However, this is not advertising by the companies, but editorial content.
§ 6 Sending e-mail
Insofar as the provider expressly opens up the possibility of submitting applications or other legally relevant declarations to the provider electronically as part of its offer, the transmission of these is at the user's own risk. This applies in particular to time-bound applications and declarations to the provider. The specified procedure or the specified e-mail address must be used to submit the declaration. Unless expressly stated otherwise, the provider cannot guarantee that the declarations received cannot be intercepted or falsified.
§ 7 Posting and submitting content/comment guidelines/netiquette
If content is made available to the provider for posting on the service, the following applies:
The provider reserves the right not to publish any submissions on the service, or to publish them in abridged or otherwise modified form. There is no entitlement to publication. If content is made available for the provider's service, it must not be illegal or offensive or directly related to party politics. The content must be checked for accuracy and permissibility. If the incorrectness or inadmissibility of the content provided is subsequently recognized, the person who provided the content is obliged to inform the provider immediately.
By submitting content, the provider is granted the non-exclusive, royalty-free, temporally and geographically unrestricted right to store, use and distribute this content in modified or unmodified form on the Internet and via other media with or without naming the author, unless otherwise agreed with the provider.
The Provider shall be indemnified against all claims asserted by third parties on account of or in connection with the content made available by the User. No direct or indirect advertising may be disseminated on the provider's online services.
Anyone who posts or sends content to the www.wiesbaden.de platform undertakes to show consideration for the cultural and religious interests of other users and in particular not to use any defamatory, libellous, insulting, threatening, obscene, pornographic, youth-endangering, racist, extremist or otherwise unlawful or immoral statements, images or similar.
Directly party-political advertising or the like is prohibited. The same applies to commercial or private offers of goods or services.
If the incorrectness or inadmissibility of the content provided is subsequently recognized, the provider is requested to be informed immediately.
Anyone who posts content must also ensure that the content linked to also meets these requirements.
The provider reserves the right to remove content and exclude the user concerned from interactive services if it suspects that the requirements of these terms of use are being violated.
The legal responsibility for violations lies solely with those who have posted this content or created a link to it. You must indemnify the provider against any third-party claims resulting from your conduct and, in the event of a legal dispute, support the provider in the defense against any claims asserted.
