Profile and tasks of building supervision

As building supervisors, we are an important part of the city administration and make a significant contribution to the safety and design of the city of Wiesbaden. We are competent and reliable partners for the construction process, mediate between different interests on an equal footing and see ourselves as responsible decision-makers.

We apply public law within the scope of our discretionary powers in a targeted and pragmatic manner. Profile

Building supervision is the responsibility of the state and is generally carried out by the lower building supervisory authorities of the municipalities and districts. The lower building supervisory authorities work to ensure that the applicable regulations are complied with during the construction, modification, demolition, use, change of use and maintenance of buildings. Buildings and other structures must not pose a risk to life, health or the environment.

As the Lower Building Supervisory Authority, the Wiesbaden Building Inspectorate is an office of the Wiesbaden City Council and therefore part of the city administration. It is the point of contact for your building projects in Wiesbaden and supports you in their realization by providing comprehensive advice on all matters relating to construction.

Tasks and activities of the building inspectorate

The building inspectorate:

  • issues building permits (demolition, new construction, conversion and changes of use),
  • issues preliminary building permits,
  • issues deviations, exemptions and exceptions,
  • advises on public building law,
  • monitors building projects for compliance with the relevant public law regulations,
  • grants access to files,
  • provides information from the building register,
  • issues certificates of completion in accordance with the German Condominium Act (WEG),
  • carries out acceptance inspections of temporary buildings,

and many more.

The building inspectorate not only decides on preliminary building inquiries or building applications in accordance with § 65 and § 66 of the Hessian Building Code (HBO), but also handles notifications for projects that do not require a building permit in accordance with § 63 and the exemption from approval in accordance with § 64 HBO. It also issues permits for isolated deviations (and exemptions) from municipal statutes.

Hazard prevention

The building inspectorate also monitors buildings as part of hazard prevention. In this way, it ensures compliance with public law regulations and takes the necessary measures at its discretion to avert danger to the general public or the individual.

However, the building inspectorate does not see this as a purely regulatory instrument. Rather, it is aware of the often differing interests of building owners, users and residents and, through this monitoring, helps to ensure that all parties involved can get along with each other. Building control is therefore not only a guarantee of safety, but also mediation and a precaution for fair and equitable interaction.

Lower monument protection authority

The Wiesbaden Building Inspectorate is also home to the Lower Monument Protection Authority. Large parts of the city of Wiesbaden, including the historic town centers of the suburbs, are listed buildings. The Lower Monument Protection Authority advises owners, architects, craftsmen and other interested parties if, for example, they wish to acquire a listed building, carry out renovation and/or other construction work on listed buildings or plan a new building in a listed area of the city. It also provides information on possible financial subsidies, tax concessions and the approval process.

Other tasks

The building inspectorate also issues certificates in accordance with the law on residential property and permanent residential rights, the so-called "Abgeschlossenheitsbescheinigungen", and approves property divisions where necessary. It maintains the register of building encumbrances and provides information from it. It also fulfills the tasks assigned to it under the Building Energy Act (GEG). In addition, the archives of the building inspectorate provide access to completed building permit processes (in compliance with data protection regulations).
