Before submitting an application, it is advisable to find out about existing building permits and building encumbrances for the property to be built on.
In the building file archive of the Wiesbaden building inspectorate, you can inspect files of completed earlier building permit processes.
We recommend that you seek preliminary advice from the building inspectorate before submitting your application. There you will receive general information on planning law and comprehensive details on, among other things
whether and which approval procedures or notifications are required for the realization of a project,
which formal conditions must be complied with when submitting an application,
which building documents must be enclosed with a building application,
which specialist bodies are involved in the approval process,
which ancillary building permits and approvals the client must obtain on their own responsibility outside of the building supervisory procedure.

To enable us to provide you with comprehensive and complete advice, please bring the following documents with you:
Details of the building plot: street + house number or district, parcel, parcel(s), this information can be found, for example, in land register extracts and property plans;

The Hessian Building Code stipulates the involvement of persons authorized to submit and verify building documents for design planning. The preliminary consultation of the building inspectorate cannot take over the tasks of an expert design author for you. We therefore recommend that you appoint an appropriate specialist for the preparatory discussions with the building inspectorate as well as for the planning and application of your building project, as only general questions about the building plot can be answered without a planning basis.

Legal basis
The basis for every planning of a building project is the application of the valid legal provisions of the building planning and building regulations law in relation to the respective building plot, as well as the local building regulations of the state capital Wiesbaden. Before building in existing buildings, the respective bases must be carefully determined in order to be able to derive the protection of existing buildings in a legally secure manner and to apply the relevant public law regulations lawfully.
Building planning law regulates the question of whether and how a property may be built on. A distinction is made between building projects that are to be carried out within the scope of a development plan, in the inner or outer area.

The protection of existing buildings is of central importance in public building law. In principle, all buildings for which a valid building permit was available at the time of construction and which were constructed in accordance with this permit are protected as existing buildings.
