Arbitration offices

The arbitration offices conduct arbitration hearings on civil disputes in accordance with the Hessian Arbitration Office Act. They are also the competent arbitration body in criminal matters. The arbitrators, who perform the duties of the arbitration office on an honorary basis, are elected by the municipal council. They must be confirmed by the board of the local court, which also exercises direct supervision over them.

The duties of the arbitration offices in detail:

  • In civil law disputes, arbitration proceedings are generally held for property claims, claims arising from neighboring rights and disputes due to violation of personal honor.
    According to the Hessian law regulating the out-of-court settlement of disputes, the arbitration offices are also recognized conciliation offices for the implementation of compulsory conciliation proceedings. This applies in particular to so-called neighbor disputes and claims for defamation, unless the offense was committed in the press or on the radio. In these cases, a conciliation procedure (e.g. before an arbitration board or another recognized conciliation body) must first be carried out before recourse can be made to the courts. However, the disputing parties must live in Hesse or have a registered office or place of business there.
    The arbitration office in whose district the other party lives is responsible or, in the case of rental and lease disputes concerning premises, the arbitration office in whose district the premises are located.

  • In criminal cases , the arbitration office only becomes involved in certain offenses. These are trespassing, insult, violation of the secrecy of correspondence, assault, threats and damage to property. The arbitrator has no jurisdiction in other criminal matters. A private action for the aforementioned offenses can only be brought if the conciliation proceedings before the arbitration office have been unsuccessful.
