Application in accordance with tree protection statutes in the built-up urban area (inner area)

Trees in the inner area (built-up urban area) are protected under certain conditions by the statutes for the protection of trees in the state capital of Wiesbaden (tree protection statutes). The felling of protected trees and the implementation of extensive pruning measures on protected trees must be applied for at the Environmental Agency. Felling permits can be combined with replacement planting or payment into a tree fund.

Which trees are protected?

  • The statute protects trees in the locally defined area of application (see link "Geoportal: Area of application of the tree protection statute").
  • Deciduous trees with a trunk circumference of 80 centimetres or more, conifers of 100 centimetres or more, measured at a height of 100 centimetres above the ground. For multi-stemmed trees, see the text of the statutes.
  • Trees may also be protected by other regulations, such as development plans, monument protection, nature conservation law and species protection. Information can be obtained from the relevant authorities.
  • The application can be submitted online (see below).

You will need the following documents for the application:

  • A site plan on which the affected tree(s) are marked. This plan can also be created in the online application.
  • Meaningful photos
  • If you are not the sole owner of the property, you will need a declaration of consent from all owners as authorization to apply. You can download a corresponding template below.
  • In the case of measures in connection with a building project, the file number of the building application and the associated open space plan must also be submitted.
