Water consumption tax statutes lawful according to administrative court

On Tuesday, April 8, the Wiesbaden Administrative Court upheld a lawsuit filed by the state capital of Wiesbaden against the municipal supervisory authority. The latter had revoked the municipal water consumption tax in May 2024 due to legal concerns.

"The Administrative Court has confirmed the legal opinion of the City of Wiesbaden and determined that the water consumption tax statutes are lawful and that the objection raised by the municipal supervisory authority must be lifted. This is a success. The City of Wiesbaden will now examine whether the previously suspended tax collection should now take place," explains Milena Löbcke, Head of Legal Affairs.

In December 2023, the city council decided to introduce a water consumption tax, which provides for a tax of 0.90 euros per cubic meter of drinking water. This is intended to provide an incentive to use water sparingly in times of increasingly dry periods.

An appeal was expressly permitted, meaning that a review of the case before the Hessian Administrative Court is possible.
